General remarks
In principle, a lawyer can only represent his clients before the courts of the U.S. state in which he is admitted by the bar association. Representation before federal courts, on the other hand, partly requires a special admission, which also depends on the respective case that is to be brought.
In principle, there is no legal regulation in the USA corresponding to the German legal institution of compulsory representation by a lawyer. However, due to the differences between the U.S. and German legal systems, it is advisable to consult a lawyer in the event of legal disputes.
There is no fee schedule for attorneys in the USA. Lawyers usually charge hourly fees between $100,- and $500,- contingency fee or sometimes a one-time fixed fee. Therefore, it is recommended that a written agreement on the fee be reached before the client is retained. Often, a high down payment on the expected costs is to be paid before the lawyer takes action. Unlike in Germany, each party usually pays its own attorney's fees, even if it prevails.
Inmates are entitled to a public defender if they are indigent. Legal aid is granted in some U.S. states to litigants who reside there. The local bar associations sometimes provide free legal advice and offer a lawyer referral service in cases of indigence.
A US-American notary public is not comparable with a German notary. The activity as a notary public, to certify signatures and sometimes also photocopies, does not require any previous legal training.
